Introduction

These Terms of Service ("Terms") govern your use of InstantOF, a web-based application platform with blockchain integration. By creating an account or using InstantOF, you agree to these Terms. If you do not agree, do not use the platform.

1. Service Description

InstantOF is a web-based platform that enables users to create and manage personalized applications with blockchain, AI, and e-commerce features. By using our platform, you agree to comply with these Terms of Service.

2. Account and Authentication

2.1 Account Creation

• You must choose a unique ticker/username
• You must create a secure PIN for authentication
• You are responsible for keeping your PIN confidential
• You must be at least 13 years old (16 in the EU) to use InstantOF

• You own all content you create on InstantOF
• You own your customer relationships and data
• You keep 100% of your sales revenue (minus payment processor fees)
• We do not claim ownership of your intellectual property

4. Payment Processing and Fees

4.1 Payment Methods

InstantOF supports the following payment methods:

• Square: Credit/debit card processing
• Solana: Cryptocurrency payments (SOL, USDC, custom tokens)

4.2 Payment Processor Fees

• Square charges approximately 2.9% + $0.30 per transaction
• Solana blockchain charges gas fees (typically $0.00025 - $0.01 per transaction)
• These fees are charged by the payment processors, NOT by InstantOF

4.3 Service Fees

• Platform Access: Free to create and use your app
• Go Global (Mainnet Deployment): One-time $4.99 fee to deploy your token to Solana Mainnet
• Transaction Fees: InstantOF does NOT take a cut of your sales

5. Refund and Cancellation Policy

5.1 No Refunds Policy

All sales are final. InstantOF does NOT provide refunds for any services, features, or transactions, including but not limited to:

• Go Global (Mainnet Deployment): The $4.99 fee is non-refundable once deployment begins
• Cryptocurrency Transactions: Blockchain transactions are irreversible and cannot be refunded
• NFT Purchases: Non-refundable due to blockchain immutability
• Shop Purchases: Refund policy is set by the individual app owner (not InstantOF)
• Payment Processor Fees: Third-party fees (Square) are non-refundable

5.2 Dispute Resolution

For payment disputes related to purchases made through an app:

• Shop purchases: Contact the app owner directly - they handle all customer transactions and disputes
• Go Global payment: Contact support@InstantOF.com for issues with the $4.99 mainnet deployment fee
• Payment processor issues: Contact Square or your bank directly for transaction problems

6. Intellectual Property

6.1 Your Content

• You retain full ownership of all content you create
• You grant InstantOF a license to host and display your content
• You are responsible for ensuring you have rights to upload content
• You must not upload copyrighted content without permission

6.2 AI-Generated Content

• Content generated by AI (text, code, images) is owned by you
• AI-generated content may not be copyrightable under current law
• You are responsible for reviewing and verifying AI-generated content
• We are not liable for accuracy or quality of AI-generated content

6.3 InstantOF Intellectual Property

• InstantOF name, logo, and platform design are our property
• You may not use our trademarks without permission
• You may not reverse engineer or copy the platform

7. Acceptable Use Policy

7.1 Prohibited Activities

You may NOT use InstantOF for:

• Illegal activities or content (drugs, weapons, terrorism, etc.)
• Malware, viruses, or malicious code
• Spam, phishing, or fraudulent schemes
• Harassment, hate speech, or threatening content
• Child sexual abuse material (CSAM)
• Intellectual property infringement
• Money laundering or terrorist financing
• Securities fraud or unlicensed financial services
• Impersonation or identity theft
• Automated scraping or data harvesting without permission

7.2 Consequences

• Violations may result in immediate account suspension or termination
• We may report illegal activity to law enforcement
• No refunds will be provided for terminated accounts

8. Third-Party Services

InstantOF integrates with third-party services (OpenAI, Square, Solana, etc.). These services have their own terms of service:

• You must comply with third-party terms when using integrated features
• We are not responsible for third-party service availability or performance
• Third-party fees and charges apply as described by those services
• See our Privacy Policy for the full list of third-party services

Your use of InstantOF is governed by our Privacy Policy. Key points:

• We collect session data, cookies, analytics, and usage information
• We use third-party services that process your data
• We do NOT sell your personal data
• Blockchain transactions are public and permanent
• You can request data deletion (except blockchain data)

11. Service Modifications and Termination

11.1 Service Changes

• We may modify, suspend, or discontinue features at any time
• We may change pricing with 30 days notice
• We may update these Terms with notice
• Continued use after changes constitutes acceptance

11.2 Account Termination

• You may delete your account at any time
• We may suspend or terminate accounts for Terms violations
• We may terminate accounts with 30 days notice for any reason
• Upon termination, you have 30 days to export your data
• No refunds for terminated accounts

12. Dispute Resolution

12.1 Informal Resolution

Before filing a legal claim, you agree to attempt informal resolution by contacting us. We will attempt to resolve the dispute within 60 days.

12.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than court litigation, except for:

• Small claims court disputes
• Intellectual property disputes
• Emergency injunctive relief

12.3 Governing Law

These Terms are governed by the laws of the United States and the state of Delaware, without regard to conflict of law principles.

12.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.

13. Age Requirements

• Minimum age: 13 years old (16 in the EU)
• Cryptocurrency features: May require 18+ depending on jurisdiction
• If you are under 18, you must have parental consent

We strive to make InstantOF accessible to users with disabilities. If you encounter accessibility issues, please contact us.

15. International Use

• InstantOF is hosted in the United States
• Some features may not be available in all countries
• You are responsible for compliance with local laws
• Cryptocurrency regulations vary by jurisdiction

16. AI Services Notice

InstantOF uses AI services (GPT-4, Claude, GPT-Image-1) that:

• May generate inaccurate, biased, or inappropriate content
• Require human review before use in production
• Are subject to third-party terms (OpenAI, Anthropic)
• May process your prompts according to third-party privacy policies

17. Force Majeure

We are not liable for failures or delays due to events beyond our reasonable control, including:

• Natural disasters
• Pandemics or public health emergencies
• Blockchain network failures
• Third-party service outages
• Government actions or regulations
• Internet or telecommunications failures

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
